Featuring Winston Shrout
At this Los Angeles seminar there were many students there from many levels of knowledge and experience, SIC tried to have items for all. One thing of importance to all students of commerce is the position that they have in regards to the public entities and contracts. Regardless of the educational and experience level of any student, that knowledge is enhanced by a solid foundation in the basis of commercial redemption which is largely involved in "lien position". In the world of commerce where "paper" is the norm, then one's relationship to "paper" is of paramount concern. Control of the "paper" at whatever stage is essential for successful navigation on the seas of commerce. So, to enhance the students position on the "paper" there was given much emphasis to LIEN POSITION.do you have it, what is your position, what gives you the lien right, who is in first lien position? Examples of former UCC-1 Financing Statements submitted on "State" forms (rather than the National forms) and filed into the County Recorder (rather than filed with the Secretary of State) were discussed. Also, there was much emphasis of the commercial lien process. So, along with other ancillary items being discussed (mortgages, lease agreements, IRS 1099OID, Article 9 of the UCC, Accepted for Value, etc.), students were admonished to get their position firm on the "paper" of the commercial world.
